Big changes to wills in England and Wales?

Early in 2025 we expect to see the publication of a new bill that will mean wills can be signed and witnessed electronically.

Current law dating back to 1837 means wills in England and Wales need to be printed on paper and signed and witnessed in pen and ink. A temporary amendment allowing wet signatures to be witnessed online was introduced during the Covid pandemic, but expired in January 2024.

Now the Law Commission is expected to publish a draft bill which will overhaul the rules around wills for the first time in nearly 200 years.

Videosign has been arguing for this change for some time, and will be following progress of the bill closely in the coming months.

Allowing digital signing and remote witnessing for wills has the potential to increase security and reliability of these important documents, reducing probate delays and disputes.

Smarter solutions for fighting fraud

During 2024 we saw a huge increase in online identity fraud, as criminals learned to exploit AI technology through deepfake scams and digital document fraud.

For the first time last year, criminals created more digital forgeries than paper counterfeits. We believe 2025 is the year that businesses and consumers will recognise this threat and start to pay more attention to digital document security.

We have spent years advocating for using digital solutions for signing, witnessing and contracting – done right, the advantages of convenience, security and efficiency are huge – so we want all businesses to make 2025 the year they take charge of their security arrangements to protect themselves and their clients from criminals.

Increased adoption of digital signatures

We predict a continued rise in adoption and use of digital signatures throughout 2025.

Economists have predicted massive growth in the technology by 2032 as more people become aware of the benefits of remote signing and witnessing.

Growth is expected to be driven by increased adoption by a number of industries including the legal and healthcare sectors.
